I have been getting a lot of calls lately about the use of GPS systems by private investigators with regards to infidelity and cheating spouse cases. This technology is all the buzz these days, and many people believe it is the end all to see if their wife or husband is cheating on them.
Seldom though, do I get asked the most important question of all. Is it legal to use a GPS Tracker to follow a spouse or see where they have been? This is a very tricky and touchy subject. It is has some local ramifications, thus I will speak for those of us practicing as Colorado Private Investigators.
Certain court rulings have seen the laws of “Stalking” & “Harassment” within Colorado applied to the use of a GPS tracker on a wife or husbands car under certain circumstances. As a Greeley Private Investigator this has many ramifications to my business. I can still legally use trackers in specific situations however, due to or own legal concerns for ourselves and our clients we do not use this technology, nor can we recommend our clients to use a GPS tracker to follow a cheating husband or cheating wife.
Just for clarification, there are two types of basic trackers. Live trackers and Reporting Trackers. The later, Reporting GPS Trackers, upload data once a day to a server so you can go online and view a map and see where the vehicle has been and for what duration. Live GPS Trackers usually have the reporting feature, however they also allow for “Live” tracking of the vehicle via a laptop, computer, smart phone or other type of device that has access to the internet.
